The University Grants Commission (UGC) recently released its new list of fake universities and warned students about admission to these educational institutions. UGC chairman M Jagadesh Kumar answered some questions about how the higher education regulator identifies and operates these fraud universities. Here are the questions and answers.
What is a fake university?
Jagadesh Kumar: To understand what a fake university is, let’s see how a university is defined in section 2(f) of the UGC Act, 1956:
“University” means an institution established or established by or under a central, provincial or state law, and includes any institution which, in consultation with the relevant university, may be recognized by the Commission in accordance with the regulations made on its behalf under this Act.
Further, under Section 22 of the UGC Act, the right to confer or confer degrees may only be exercised by a university established or incorporated by or pursuant to a central law, a provincial law or a state law or an institution acting as a university. is considered under Article 3 or an institution specially authorized by law to award or confer degrees.
Thus, no person or authority other than those who meet these criteria may confer, or confer, any degree, or pretend to be entitled to confer or confer it.
“Degree” here means such degree with the prior approval of the central government and specified by the Commission upon notification in the Official Gazette.
Any institution not established under UGC law and offering degrees in violation of these terms is a bogus institution.
Q. How does the UGC identify fake universities across the country?
Jagadesh Kumar: Such cases come to the notice of the UGC through print or electronic media, upon receipt of a complaint from the public or students, references from state/Union territories/local authorities and a court decision, etc.
The UGC’s Anti Malpractice Cell (AMPC) has been functioning since May 30, 1996. The aim of the AMPC is to curb the threat of fake universities and degrees. The cell deals with all matters related to the existence/functioning of fake or unrecognized universities/institutions that operate in violation of the UGC Act. The AMPC liaises with various agencies of the central/state governments to monitor the threat of fake and unrecognized institutions and also calls on the states/Union territories and local authorities to take action against such institutions for violating the UGC law and other criminal laws.
We ask the general public to contact the UGC if they find an institution offering degrees in violation of UGC rules.
What does the UGC do if a fake university is identified?
Jagadesh Kumar: the UGC iissues trigger/warning notices to unauthorized universities that award invalid degrees. It issues press releases and public announcements with a state-by-state list of fake universities in the country. We are also writing to Head of State Secretaries, Education Secretaries and Chief Secretaries to take action against the fake universities/institutions under their jurisdiction and at the direction of the UGC.
Is there a list of fake universities that students can refer to?
Jagadesh Kumar: TThe UGC includes the name of self-proclaimed institutions that do not follow the rules in the list of fake universities. Currently, 21 fake universities/institutions are included in the list of fake universities maintained by the UGC, which is also available on the official website:
